Pooled Special Needs Trusts and Medicare Set Aside: Use Them Together to Settle the Case
Published by Workers' Injury Law & Advocacy Group and Oklahoma Association for Justice

Summary
When the case includes an MSA, its existence can jeopardize benefits such as SSI and Medicaid for those who receive them. Not planning for your client’s means-tested government benefits can result in legal malpractice or breach of fiduciary duty. In this webinar, attorneys will learn how careful planning to nest the MSA in a PSNT allows management of the set-aside portion of the funds and the remainder of the settlement proceeds, while protecting eligibility for means-tested benefits, and ensuring that injury-related expenses are covered.

Topics to be covered:
• CMS Interpretation of MSP Act
• Public Benefits Primer
• Pooled Special Needs Trusts
• Using MSA and PSNT together
• Incorporating Structured Settlements
